We are selling a car, we prepare the file, and at the moment of signing, the buyer requests the certificate of non-encumbrance. Without this document, no change of registration certificate is possible. The transaction is blocked.

The certificate of administrative situation (CSA), commonly referred to as the certificate of non-encumbrance, certifies that a vehicle is not subject to any encumbrance or opposition to the transfer of ownership. It directly protects the buyer against acquiring a vehicle whose sale would be legally impossible.

Certificate of non-encumbrance for scrapping: an unknown case

It is often thought that this document only concerns resale between individuals. In practice, the CSA is also required to send a vehicle for destruction. An authorized VHU (end-of-life vehicle) center requests a certificate of administrative situation dated less than fifteen days before accepting the vehicle, even if it will never be put back into circulation.

The logic is simple: if the vehicle is encumbered (for example, an auto loan is not paid off), the creditor retains a right over it. Destroying an encumbered asset without lifting the encumbrance would pose a legal problem. The CSA thus secures the deregistration process in the vehicle registration system (SIV), the destruction certificate, and, if applicable, the payment of a conversion bonus.

When one understands the definition and utility of the certificate of non-encumbrance, it becomes clear that its scope far exceeds simple second-hand sales.

Encumbrance and opposition: two distinct blockages on the registration certificate

The CSA combines two attestations into one document. Confusing encumbrance and opposition is a common mistake, and it complicates problem resolution.

The encumbrance on a vehicle

A vehicle is encumbered when it serves as collateral for a creditor, most often a credit institution. As long as the loan is not fully repaid, the owner cannot freely transfer the vehicle. To lift the encumbrance, one must obtain a release from the creditor, confirming that the debt is settled. This release is then recorded in the SIV.

The opposition to the transfer of ownership

The opposition is an administrative blockage triggered by the State itself. The most common reasons include:

  • Unpaid increased fixed fines (unsettled tickets sent to the public treasury)
  • A vehicle reported stolen, for which legal proceedings are ongoing
  • An administrative immobilization ordered by the prefect (for example, failure to pass the technical inspection)

To lift an opposition, one must first resolve the cause of the blockage (pay the fine, return the stolen vehicle, regularize the technical inspection). The effective lifting can take several days after settlement, and the response times vary depending on the workload of the concerned service.

Histovec: the CSA is no longer sufficient to verify everything

Since the generalization of the Histovec platform by the Ministry of the Interior, the seller can generate a complete vehicle history report. This report includes the certificate of non-encumbrance but goes much further: changes of ownership, accidents, potential professional use.

For a buyer, consulting only the CSA is like checking that a door is unlocked without looking at the state of the house. The Histovec report does not replace the CSA (which remains the legally required document), but it significantly complements the information.

In practice, the seller generates a secure link from Histovec and sends it to the buyer. The latter accesses the history without needing the seller’s credentials. The Histovec report is free and can be consulted online, just like the CSA itself.

Obtaining the certificate of administrative situation: deadlines and validity

The request is made exclusively online, on the ANTS (National Agency for Secure Titles) website. This document is no longer obtained at the prefecture since the digitization of registration procedures.

The process is quick: one enters the registration number and the certificate of registration formula number, and then the document is generated in a few minutes in PDF format. The CSA is free and must be dated less than fifteen days at the time of the transfer.

This fifteen-day deadline is not a detail. A CSA obtained three weeks before the signing no longer protects anyone: an encumbrance or an opposition may appear in the meantime. It is advisable to download it on the day of the sale or the day before.

Which vehicles are concerned

The certificate of non-encumbrance is mandatory for any motor vehicle already registered in France and subject to a transfer: car, motorcycle, scooter, utility vehicle, camper van. Registered two-wheelers are therefore included, which some sellers may overlook.

The CSA is also required for vehicle donations between individuals, not just for sales for a fee.

Encumbered vehicle discovered after purchase: what recourse

If the buyer discovers an encumbrance after the transaction, the situation becomes complicated. Without a valid CSA provided before the sale, the buyer can hold the seller liable for hidden defects. The registration certificate cannot be issued in their name until the encumbrance is lifted.

In practice, resolution often involves direct negotiation with the seller to settle the loan. In case of refusal, legal proceedings remain possible, but they take time and incur costs.

The certificate of administrative situation exists precisely to avoid this type of situation. A buyer who agrees to conclude without a valid CSA takes a real risk, even if the seller claims that the vehicle is free of any encumbrance.

The CSA remains the only official document that guarantees the legal feasibility of a change of ownership. Downloading it takes a few minutes, costs nothing, and protects both parties. It is the simplest document in the sales file, and paradoxically the one that blocks the most transactions when it is missing.
